1. About us
Welcome to Kinly. "We", "us" and "our" refer to Kinly, the online store at regalalo.store, owned by Juan Brotons Llin (Tax ID 49744264W, Ptda. de l'Ombria, 32-57, 46870 Ontinyent, Valencia, Spain; email hola@regalalo.store). Our store runs on the Shopify platform. By visiting or buying from our store you agree to these Terms of Service and to the policies they refer to. Please read them carefully.
2. Using the store
To buy from us you must be at least 18 years old and able to enter into a contract. You agree to give us accurate, current and complete information when you place an order.
3. Important information about the product
The Kinly SOS bracelet is a personal alert device that sends a notification to the phones of the family members you choose. Please read this before you buy:
It is not a medical device. It is not monitored 24/7 by a call centre and it does not contact emergency services.
It only works while it is powered and connected to a 2.4 GHz home Wi-Fi network with a working internet connection, and while the free Smart Life app is installed, with notifications turned on, on at least one phone. It does not work outside the range of that home Wi-Fi network.
An alert may be delayed or may not arrive if the Wi-Fi, the internet connection, the power, the app or the receiving phone is not working.
In an emergency, always call your local emergency number (911 in the US and Canada, 999 in the UK, 000 in Australia, 111 in New Zealand).
The Smart Life app is provided by a third party. We are not responsible for its availability, its changes or its terms of use.
4. Prices and payment
Prices are shown in your local currency and include free shipping. Offers, such as "Buy 2, save 15%", are applied automatically at checkout. We may correct any pricing or description errors and, if an error affects your order, we'll contact you before shipping so you can confirm or cancel it with a full refund.
5. Orders
After you place an order you'll receive a confirmation email. The contract is formed when we confirm your order. We may refuse or cancel an order, for example if a product is unavailable or we suspect fraud; in that case we'll refund you in full.
6. Shipping, returns and refunds
Shipping is governed by our Shipping Policy and returns and refunds by our Refund Policy, including our 90-day money-back guarantee.
7. Your statutory rights
Nothing in these Terms limits the rights you have as a consumer under the laws of your country of residence, including the 14-day right to cancel in the United Kingdom and the consumer guarantees under the Australian Consumer Law and New Zealand's Consumer Guarantees Act 1993.
8. Intellectual property
All content on the store (texts, images, logos and design) belongs to us or to third parties who have authorised its use. You may not use it without our written permission.
9. Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for losses caused by events beyond our reasonable control. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
10. Privacy
We process your personal data as described in our Privacy Policy.
11. Changes to these Terms
We may update these Terms from time to time. The version published on the store when you place your order applies to that order.
12. Governing law
These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring a claim in the courts of your own country.
